ANJANA MISHRA ORAL ORDER 16-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing for the North Bihar Power Distribution Company Ltd. (Rural), Muzaffarpur.
It appears from the order passed by this Court that the removal of the petitioner was set aside with liberty to the opposite parties to proceed afresh against the petitioner, in accordance with law following, the principle of natural justice. However, the North Bihar Power Distribution Company reinstated the petitioner but what remains now is payment of admitted dues. According to the Power Holding Company, they have prepared a cheque of
Patna High Court MJC No.1223 of 2015 (13) dt.16-02-2018 2/2 Rs.3,703/- towards payment of admitted dues of the petitioner, whereas, according to the learned counsel for the petitioner, the petitioner is entitled to receive a total sum of Rs.20,83,887/-, which is the franchise commission. It thus appears that what is admitted by the opposite parties is but a pittance and there is some anomaly in their calculations.
It would thus be advisable that the opposite parties and the petitioner shall sit across and settle their facts and figures. The decision on this matter should be taken by Opposite Party No.3-Executive Officer, North Bihar Power Distribution Company Ltd. (Rural), Muzaffarpur. Let the Managing Director, North Bihar Power Distribution Company Ltd., Muzaffarpur (Opposite Party No.2) also take appropriate steps in the matter and depute a responsible officer, who shall consider the claim of the petitioner, in accordance with law within three weeks.
If the case of the petitioner is decided against him, liberty is afforded to the petitioner to raise his claim in an appropriate forum in accordance with law.
With the aforementioned observations, the contempt application stands disposed of.
