JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Nasriganj (Rajpur) P.S. Case No. 25 of 2018 registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor daughter of the informant.

Submission of learned counsel for the petitioner is that the victim is major and as a matter of fact she fled away on her own sweet will and she has been brought by her father and on the pressure of father she has disclosed the name of the petitioner.

Heard learned APP also, who has opposed the prayer for anticipatory bail stating that in her statement under Section 164 Cr.P.C. the victim has disclosed the name of the petitioner

Patna High Court CR. MISC. No.27325 of 2019(5) dt.09-07-2019 2/2 and according to FIR she is minor.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, petitioner may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
