The petitioner apprehends his arrest in connection with Dehri P.S. Case no. 502 of 2016, registered under Sections 406, 420, 323, 379, 504 and 506/34 of the Indian Penal Code. The accusation is that petitioner took cash of Rs. Four Lakhs from the informant for urgent work and also signed on the stamp paper to the effect that she will return the money within one year in case of non-returning of the money, she will execute sale deed in respect to house of her share, but on demand of the money petitioner did not return the money to the informant and she also evade to execute the sale deed in terms of the agreement. When informant send the legal notice then on 23.06.2016 petitioner and her sons Vinay Kumar and Vishal Kumar came at the door of the informant and
Patna High Court Cr.Misc. No.51768 of 2017 (2) dt.02-11-2017 2/2 started to abuse her at that time Vinay Kumar took Rs. 1500/- from his pocket.
Learned counsel for the petitioner submits that petitioner is innocent and she has falsely been implicated in this case. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Dehri, Rohtas in connection with Dehri P.S. Case No. 502 of 2016, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
