Mr.Lalit Kishore (Ag) ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL JUDGMENT Date : 06-01-2022 The matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 pandemic.

2. In the instant petition, petitioner has prayed for the following relief/reliefs:

"(i) For issuance of an appropriate writ / order/ direction to quash the final result of 64th joint competitive examination whereby and whereunder the candidature of petitioner has been cancelled saying that petitioner failed to produce certificate of Bachelor

Patna High Court CWJC No.12208 of 2021 dt.06-01-2022 2/2 degree on the date of interview for verification though the petitioner already submitted self attested original certificate of Bachelor degree through speed post before the publication of final result as suggested by the Commission.

(ii) For issuance of an appropriate writ / order/ direction to the respondents Commission that permitting the petitioner to face interview and cancellation of candidature after interview is illegal and the respondents ought to have considered the petitioner's candidature during preparation of final merit list of publication final result.

(iii) For issuance of an appropriate writ/ order/ direction to the respondents Commission to treat the petitioner's candidature valid as petitioner already submitted original mark sheet at the time of interview which is equivalent to the Bachelor degree showing passed.

(iv) For issuance of an appropriate writ/ order/ direction to revise the final result of 64th combined competitive examination treating the petitioner's candidature valid and to prepare merit list of the petitioner category and to publish final result thereafter.

(v) For issuance of an appropriate writ/ order/ direction granting any other relief or reliefs for which the petitioner is found entitled."

3. The petitioner have not arrayed the persons' names reflected in the final result of 64th joint competitive examination.

4. Accordingly, the present petition stands dismissed for non joinder of necessary and proper parties, reserving liberty to the petitioner to file a fresh petition.
