2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 353, 379, 384, 427, 504, 34 of the Indian Penal Code.

3. It is alleged that F.I.R. named persons including these petitioners alongwith one co-accused Sudhir Singh alongwith 8-10 unknown persons abused and assaulted the labourers, who were constructing dumping waste house and also threatened the labourers of dire consequences, if they continue to work.

4. It is submitted on behalf of petitioners that allegation is general and omnibus and no specific overt act has been alleged against these petitioners. The F.I.R. has been

Patna High Court CR. MISC. No.29670 of 2023(3) dt.19-08-2023 2/2 lodged by the Mukhiya of the concerned Gram Panchayat, who was inimical to them and only with a view to wreak personal vengeance has lodged the present false case. Petitioners have clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran in connection with Sugauli P.S. Case No. 320 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
