JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2019 Heard learned counsel for the petitioners, learned counsel for the informant and the learned APP for the State. The petitioners seek bail in Gaurichak P. S. Case No. 340 of 2017 instituted for the offence under Section(s) 302/34 of the Indian Penal Code .

Learned counsel for petitioners has submitted that mere suspicion has been raised against these petitioners during investigation. The FIR is against unknown.

It is alleged in the written report that son of the informant received a call on his mobile and he went out of the house but he did not return in the morning. Thereafter, informant tried to contact on his mobile but the same was found

Patna High Court CR. MISC. No.27235 of 2019(2) dt.26-04-2019 2/2 switched off. At about 12.30 noon the informant got information that dead body of his son is lying on the well and the same was identified by the informant.

During investigation, it has come that the deceased has love affairs with co-villager Kiran Kumari who is daughter of Ram Vichar Singh. It has also come during investigation that deceased had talk with Kiran Kumari on mobile. The petitioners have been made accused because they are uncle of Kiran Kumari. They have no concern with the family of Kiran Kumari. They are living separate from her father Ram Vichar Singh.

Petitioners are in custody since 5.1.2019 Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM, Patna City, Patna, in connection with in Gaurichak P. S. Case No. 340 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioners.
