2. The petitioner seeks bail in a case registered for offence under Sections 302/34 of the Indian Penal Code.
3. As per F.I.R., petitioner was incharge of the Nasha Mukti Kendra and it is alleged that he along with other coaccused persons brutally assaulted son of informant, who was admitted in the aforesaid centre for his treatment, as a result of which, in course of treatment, he died.
4. This Court, vide order dated 29.08.2025, called for a report from the Court concerned regarding present stage of this case, which has been received and kept at flag 'R'. From perusal whereof, it reveals that charge has been framed and thereafter, out of six charge-sheeted witnesses, two witnesses
Patna High Court CR. MISC. No.31338 of 2025(4) dt.27-11-2025 2/2 have been examined and for examination of rest witnesses, summons have been issued.
5. Learned counsel for the petitioner submits that petitioner has got clean antecedent and is in custody since 22.01.2025. He further submits that there is no allegation of tampering with the evidence against petitioner. Chargesheet has been submitted.
6. Learned A.P.P. for the State opposes the prayer for bail.
7. Considering the aforesaid fact & circumstances as well as period of custody and clean antecedent, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S.
