Mr. Surendra Prasad Singh APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-01-2018 The petitioner has challenged the judgment and order of acquittal passed by the learned Court below vide judgment dated 15.04.2015.

From perusal of the judgment, it appears that the opposite party has been acquitted because of the petitioner not having supported the prosecution version. It appears that the main allegation raised by the petitioner was that money was deposited in an account which could have been withdrawn only by the joint signature of the petitioner in his capacity of Mukhiya of the Panchayat and the accused as member of the Panchayat. It has been alleged that an amount of Rs. 9,78,000/- was illegally withdrawn by forging his signature.

From the evidence on record, the allegations could not be

Patna High Court CR. REV. No.498 of 2015(2) dt.29-01-2018 2/2 substantiated and, therefore, the Court below has returned the verdict of acquittal.

This Court finds no ground to interfere with the same. The petition is dismissed.
