23-09-2016 The petitioners apprehend their arrest in relation to Agion (G) P.S. Case No. 54 of 2015 registered under Sections 272, 273 of the Indian Penal Code and Section 47 of the Excise Act.
It is alleged that, on or about 16.06.2015, early in the morning police officials raided the place near river bed and found illegal manufacturing of country liquor and found illegal country made liquor. All the accused persons are named in the First Information Report including these three petitioners who are indulging in distilling country liquor, but manage to escape. They have been identified by the Chowkidar.
Patna High Court Cr.Misc. No.41766 of 2016 (2) dt.23-09-2016 Learned counsel for the petitioners submits that they have been falsely implicated in this case. Inasmuch as it is not believable that if such a large contingent of police officials reached at the place, few people can manage to escape and no arrest are made.
Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioners, namely, Dharmendra Singh @ Dharmdev Singh, Om Prakash Singh @ Om Prakash Yadav and Satyendra Singh, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate - VII, Ara (Bhojpur) in connection with Agion (G) P.S. Case No. 54 of 2015, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
