The petitioners apprehend their arrest in Barauli P.S. Case No. 107 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant Junior Engineer alleged that there was counting of votes of the election of Mukhiya and the defeated candidate of Mukhiya namely Ajay Manjhi and his supporters came and they blocked the road and also pelted stones in which Chowkidar and other police constables were injured.
Patna High Court Cr.Misc. No.804 of 2017 (2) dt.12-01-2017 2/2 Learned counsel for the petitioners submits that the petitioners are merely alleged to be member of the mob, in fact, the petitioners did not participate in the protest and they have falsely been implicated in the case, merely because they were supporters of the defeated Mukhiya.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Barauli P.S. Case No. 107 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J.) KKSINHA/- U T
