Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The informant gathered information subsequently that the petitioner and others were involved in the crime alleged. Submission is that the case diary would reveal that there is no eyewitness of the occurrence. Petitioner is in custody since 31.01.2019. Investigation of the case is already complete. He was never put on Test Identification Parade. Petitioner has got no criminal antecedent nor any incriminating article was recovered from his possession.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.26433 of 2019(3) dt.12-06-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Barauni (F.C.I.) Police Station Case No.43 of 2019, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
