JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 This is an application for grant of anticipatory bail in connection with Special Case No. 2143 of 2019 arising out of Chowk P.S. Case No. 97 of 2019, disclosing offences under Sections 290, 272, 273/34 of the Indian Penal Code and Section 30(a), 37(c) of Bihar Prohibition and Excise Act, 2016.

Allegation as per the F.I.R. is that on patrolling duty he received confidential information that illegal wine was kept in a hut and thereafter the police surrounded the hut but after seeing the police petitioner is succeeded to fleeing away but six persons are arrested on the place of occurrence and they disclosed their names. Police officials has been recovered 6.8 liter liquor from the hut. All villagers disclosed that the petitioner sold liquor from the same hut. Submission of the learned counsel for the petitioner is that except confessional statement nothing has been against the petitioner and he has no criminal antecedent .

Patna High Court CR. MISC. No.29369 of 2019(3) dt.19-07-2019 2/2 Heard learned A.P.P. also who opposed the prayer for bail on the ground that he has been named not only on the basis of confessional statement of co-accused but villagers had also disclosed the name of the petitioner.

Having heard both sides, in view of that facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner.
