2. The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 109, 115(2), 121(1), 121(2), 126(2), 132, 191(1), 191(2), 191(3) and 352 of B.N.S.
3. The case of the prosecution is that the Subdivisional Officer, Jehanabad and other police officers have went to village-Indrapur for removal of encroachment on
Patna High Court CR. MISC. No.28387 of 2026(2) dt.05-05-2026 2/3 government land upon which the petitioners and other accused persons have started stone pelting.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. Learned counsel for the petitioners has submitted that the nature of allegation is general and omnibus. It is alleged that unknown persons armed with lathi-danda started abusing the police party and thereafter, attacked the informant with lathi-danda. It has further been submitted that the nature of injury is simple. It has further been submitted that similarly situated co-accused persons have already been granted anticipatory bail by learned Co-ordinate Bench of this Court vide Cr. Misc. No. 20370 of 2025. The case of these petitioners stands on similar footing. They are in judicial custody since 17.03.2026.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing
Patna High Court CR. MISC. No.28387 of 2026(2) dt.05-05-2026 3/3 bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Jehanabad in connection with Makhdumpur P.S. Case No. 12 of 2025.
