Patna High Court CWJC No.4252 of 2013 (7) dt.28-03-2016 counsel for the State, Mr. Girish Pandey, learned counsel appearing for the State Election Commission and Mr. Ravi Ranjan, learned counsel appearing for the returned candidate are present.
Perusal of the record manifests that the petitioner has questioned the judgment and order dated 15.8.2012 passed by the Munsif 2nd -cum- Election Tribunal, Vaishali at Hajipur in Election Case No.27 of 2011, whereby the prayer for recount was rejected and the election case was dismissed. The petitioner thus while questioning the judgment and order, also prays for recount.
Pursuant to the notice issued the parties have appeared and apart from the fact that the view expressed by the Election Tribunal in paragraph 13 of the judgment in support of his opinion for refusal to the prayer for recount suffers no infirmity, even otherwise that the notification of fresh Panchayat election having been issued by the State Election Commission no cause for indulgence is made out in this writ petition which is accordingly disposed of.
