JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Hathauri P.S. Case No.242 of 2019 for the offence under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-B)A, 26 and 35 of the Arms Act. Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. During course of raid at Pram Jeevar Railway Station, the petitioner was apprehended by the raiding party and from his possession, one loaded country made pistol was recovered. Petitioner is in custody since 06.12.2019.
