The petitioner seeks bail in connection with Pakaridayal P.S. Case No.110 of 2015 registered for the offence under Sections 302, 120 and 120B of the Indian Penal Code. 3.

Allegation against the petitioner is to have committed murder of unknown person along with other coaccused persons. 4.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case and petitioner is not named in the

Patna High Court CR. MISC. No.34484 of 2024(3) dt.05-08-2024 2/3 FIR, where, his name surfaced on the basis of confessional statement other co-accused, namely, Chandan Kumar Singh, who has already been granted bail by a learned co-ordinate Bench of this Court through Cr. Misc. No.42483 of 2017 on 19.09.2017. It is submitted that nothing incriminating material has been surfaced during course of investigation against this petitioner, which may connect him with the present set of murder except confessional statement of other co-accused person. It is submitted that similarly situated co-accused person has already been granted bail by a learned co-ordinate Bench of this Court through Cr. Misc. No.57999 of 2017 on 15.12.2017. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 05.12.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner and as nothing incriminating material surfaced against this petitioner during course of investigation and other similarly situated co-accused persons have already been granted bail, let the petitioner, above named, is directed to be released on bail in connection with Pakaridayal P.S. Case No.110 of 2015 on furnishing bail bonds

Patna High Court CR. MISC. No.34484 of 2024(3) dt.05-08-2024 3/3 of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-V, Motihari, East Champaran.
