ANJANA MISHRA ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing for the State.

The petitioner is in custody since 06.04.2018 in connection with Sitamarhi (Mehsaul) P.S. Case No. 631 of 2016 registered for the offence under Sections 363 and 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that the victim girl had herself gone with the petitioner and married with him out of own free will. It is submitted that in the statement made under Section 164 Cr. P.C., the girl has categorically stated that the petitioner had not enticed her away and she is now married to him and has got a child also. She has also stated her age to be of 19 years.

No.34084 of 2018 (3) dt.04-07-2018 In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi (Mehsaul) P.S.
