2. It is the first regular bail application submitted by the petitioners who have been arrested in connection with Chanan P.S. Case No. 35 of 2025 for the alleged offences punishable under Section 126(2), 115(2), 117(2), 191(2), 352, 351(2), 109, 303(2) of the Bhartiya Nyaya Sanhita.
3. According to the case of prosecution, it is alleged that on 17.03.2025 at about 08:30 P.M. due to some previous dispute allegedly all the accused persons along with other co-accused persons assaulted the informant Dashrath Saw, his son Ranjit Kumar and his grandson Prince Kumar, due to that all of them sustained injuries.
Patna High Court CR. MISC. No.26549 of 2025(2) dt.05-05-2025 2/3 Ranjit Kumar sustained injury on his vital part i.e. head. It is further alleged that at the time of incident accused persons also looted Rs. 8,000/- from the informant Dashrath Saw. On the basis of report made by Dashrath Saw offences has been registered and during the course of investigation all the accused persons herein are arrested on 09.09.2025.

It is submitted by the counsel for the petitioner that the petitioners herein are innocent and are falsely implicated in this case due to some previous dispute with the complainant and family members. He further submits that the injury sustained by the complainant and his son Shambhu Saw and grandson Prince Kumar are all simple in nature. However, the injury sustained by Ranjit Kumar is found on his head but, it was caused by co-accused Rohit Kumar and not by the present applicants. Lastly, he submits that there are no previous antecedents of any of the applicants and they are in custody since 19.03.2025. Therefore, he prayed that the petitioners may be granted benefit of bail.
5. Learned counsel appearing on behalf of respondentState opposes the prayer of bail.
6. Considering the submission made by the counsels and particularly considering the evidence available on record against the present applicants and without commenting on the other merits of the case. I am of the view that the present applicants should be granted the benefit of bail. Accordingly, the petition is allowed. The
Patna High Court CR. MISC. No.26549 of 2025(2) dt.05-05-2025 3/3 petitioners are directed to be released on bail in connection with Chanan P.S. Case No. 35 of 2025 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties, respectively to the like amount each to the satisfaction of the learned A.C.J.M. Lakhisarai.
