Mr.Rabindra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 24-04-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Shambhuganj P.S. Case No. 86/2018, instituted for offence under Section(s) 323, 341, 354, 379, 504, 506, 302 and 34 of the Indian Penal Code. Learned counsel for the petitioners has submitted that earlier petitioner was granted bail by the court below. It is mentioned in the impugned order that after death of husband of informant on 07.05.2018 Section 302 of the Indian Penal Code has been added in this case. On 09.08.2018

Patna High Court CR. MISC. No.26622 of 2019(2) dt.24-04-2019 2/3 the bail bond of the petitioners was cancelled by the court below and warrant of arrest was issued against them. Thereafter petitioners have surrendered on 13.03.2019. They are in custody since then.

Petitioners were already on bail granted by this Court. They have sufficiently been punished for their laches. In such circumstance, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Banka, in connection with Shambhuganj P.S. Case No. 86/2018, subject to the conditions that (I) both the bailors shall be the close relative of the petitioners.

(II) Petitioners shall be present on each and every date fixed by the court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioners and (III) if petitioners tamper with the
