JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Imadpur P.S. Case No. 06 of 2014, registered under Sections 341, 324, 307 and 302/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Bhojpur at Ara. Learned counsel for the petitioner submits that the prayer for anticipatory bail of the petitioner was earlier rejected on merit vide order dated 16.01.2015 passed in Criminal Misc. No. 1165 of 2015. It is further submitted that similarly situated coaccused, Pinku Yadav @ Pinku, has already been granted privilege of anticipatory bail by a Bench of this Court vide order

Patna High Court Cr.Misc. No.54864 of 2017 (2) dt.20-11-2017 dated 11.07.2016 passed in Criminal Misc. No. 14722 of 2016. Since the anticipatory bail of the petitioner has already been rejected earlier by a Bench of this court, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
