2. The petitioner seeks bail in connection with Madhubani P.S. case No. 66 of 2017 instituted for the offences under Section 392 of the Indian Penal Code.
3. Prosecution case, in short, is that when the informant was returning after collecting money from his client, the two unknown miscreants intercepted the informant and looted Rs. 84,370/-, Tab, thumb scanner, and mobile phone from him on the gunpoint.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner
Patna High Court CR. MISC. No.31555 of 2024(2) dt.25-04-2024 2/3 transpired in this case on the basis of confessional statement of the co-accused Chandan Kumar in connection with Madhuban P.S. Case No. 71 of 2017. No incriminating/looted article has been recovered from the conscious possession of the petitioner. Learned counsel further submitted that petitioner has got no concern with the looted articles. Learned counsel further submitted that T.I.P. has not been conducted till date. He further submitted that except confessional statement of the co-accused, nothing has come against this petitioner. He further submitted that co-accused persons Ravinder Singh @ Pinki Kuar, Vicky Kumar Singh and Dippu Singh have already been granted bail by a co-ordinate Bench of this Court vide orders dated 23.11.2017, 31.01.2018, 06.10.2018 passed in Cr.
Misc. No. 56147 of 2017, Cr. Misc. No. 190 of 2018 and Cr. Misc. No. 59402 of 2018 respectively. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.12.2023 and has seventeen criminal antecedents but he is on bail in all the cases.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the
Patna High Court CR. MISC. No.31555 of 2024(2) dt.25-04-2024 3/3 petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Madhubani P.S. case No. 66 of 2017.
