Allegedly, 266 quintals and 80 kilogram rice meant for Mid Day Meal was recovered and amount of Rs. 56000/- was also recovered from the truck driver and on confidential inquiry it revealed that the petitioner and co-accused Chandeshwar Sah are indulged in black marketing of Mid Day Meal Rice. Submission is of false implication and that the petitioner is not the PDS Dealer, nothing has been recovered from possession of the petitioner, he is not the truck owner, the rice recovered was not of Mid Day Meal, nothing has come that from which school the said rice was obtained and as such the petitioner deserves sympathetic consideration.
Learned APP fairly submits that the petitioner was
Patna High Court Cr.Misc. No.1034 of 2017 (2) dt.16-01-2017 not arrested at the spot.
In the facts and circumstances stated above, the petitioner above named, in case of his surrender or arrest within four months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S. K. Choudhary, J. M. Ist Class, Dalsingsarai, Samastipur in connection with Angarghat P.S. Case No. 63 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
