2. The petitioner has prayed for bail in connection with Bahadurpur P.S. Case No. 102 of 2021 registered for the offence punishable under Section 460 of the Indian Penal Code.

3. The case of the prosecution, in short, is that some unknown miscreants had committed theft in the house of the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He further submits that the name of the petitioner has surfaced during the course of investigation in the confessional

It is submitted that save and except the said confessional statement, there is no material against the petitioner. No recovery has been made from his possession, and no Test Identification Parade (TIP) has been conducted. Learned counsel further submits that the petitioner has been implicated in the present case solely on the basis of his antecedents. The petitioner is stated to have criminal antecedents in ten cases and has been languishing in judicial custody since 22.03.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner has criminal antecedent of two cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with the condition that the petitioner shall cooperate in trial and shall remain physically present on each and every date fixed by the learned court below and one of the bailors should be his near relative. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-
