28-06-2018 Heard Sri Krishna Kant Singh, learned counsel for the petitioner and Sri Mithilesh Kumar Khare, learned Addl. Public Prosecutor.
The sole petitioner, having clean antecedent which fact has been stated in paragraph - 3 of the petition apprehending her arrest in Basantpur P.S. Case No. 433 of 2017 registered for offence under Sections 272, 273, 308, 34 of the Indian Penal Code and Section 30(a), 34(b), 36 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of her arrest or surrender.
Learned counsel for the petitioner submits that in this case, nothing was recovered either from conscious possession of the petitioner or from premises of the petitioner, however; in the case, from outside house opposite a toilet, four liters of Mahua
Patna High Court Cr.Misc. No.35414 of 2018(2) dt.28-06-2018 2/2 liquor was shown to be recovered and petitioner, only on suspicion, has been made accused.
Considering the nature of accusation, clean antecedent as well as the fact that nothing was recovered from her conscious possession, in the event of her arrest or surrender within a period of six weeks from today, let the petitioner namely Chanda Devi be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2, Siwan in connection with Basantpur P.S. Case No. 433 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
