02. In the present case, the petitioner seeks bail in connection with Parnadabar P.S. Case No. 250 of 2024 registered for the alleged offences under Sections 336(2), 336(3), 338, 316(2), 318(2) of Bharatiya Nyaya Sanhita, 2023.

03. As per prosecution case, the petitioner manipulated and got transferred in the accounts of some persons the money which was meant for construction of toilets and when the money was transferred to the account of persons, the petitioner approached them and stated that the money was wrongly transferred to their accounts though it was meant for the petitioner, got the money withdrawn and paid to him by those persons.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is a daily-wager and is having no concern with the construction of toilet or making payment to persons for the said purpose. The informant is a Block Coordinator and has falsely implicated the petitioner in the present incident. Learned counsel further submits that it is not believable that a person in in whose account the money was deposited would give the money to the petitioner merely on his saying. In any case, the petitioner has deposited Rs. 60,000/- in the office of Block Development Officer under protest though it is claimed by the beneficiaries that they have not handed over all the money to the petitioner. The petitioner is in custody since 27.02.2025 and charge-sheet has been submitted. The petitioner is having clean antecedent.

05. Learned APP for the State opposes the prayer for bail. Learned APP submits that the petitioner has taken the money from the beneficiaries, each of whom received 12,000/- towards the construction of toilet in their houses.

06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation and further considering the period of

No.27832 of 2025(2) dt.07-05-2025 3/3 custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah/court concerned in connection with Parnadabar P.S. Case No. 250 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
