JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-07-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Chapra Mufassil P.S. Case No.48 of 2018 registered under Sections 467, 468, 471, 420, 379, 386 and 120B read with 34 of the Indian Penal Code.
It is submitted that there is omnibus and general allegation against eighteen FIR named accused persons, who are all neighbours of the informant. The allegation is that they used to demand Rangdari by preparing forged documents of the house. The contention is that Title Suit No.447 of 2015 and Title Suit
Patna High Court Cr.Misc. No.35793 of 2018 (2) dt.02-07-2018 2/2 No.448 of 2017 as well as miscellaneous case bearing no.04 of 2017 are pending before the court below between petitioner no.1 and members of the prosecution party which has given rise to the institution of false and frivolus complaint before police. On the other hand, learned counsel for the State submitted that the allegations are serious in nature and there is specific allegation that petitioner no.1 snatched an amount of rupees two thousand from the pocket of the informant. Considering the facts and circumstances of the case and the submissions made on behalf of the parties, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.
10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No.48 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S.
