Petitioner apprehends his arrest in C.R. No.1786 of 2015 for the offences allegedly committed by the petitioner under Sections 498A and 323 of the Indian Penal Code. Learned counsel for the petitioner submits that the complainant herself does not want to live with the petitioner and she left the house of the petitioner without any rhyme and reason. The complainant filed the case to put pressure in order to get divorce. It is further submitted that the petitioner gave undertaking before the learned Additional Sessions Judge to keep the complainant with all honour and dignity but the complainant refused to live with the petitioner.

No.31021 of 2019(2) dt.10-05-2019 2/2 It appears from the facts and the order of the learned Additional Sessions Judge that the dispute could not be resolved between husband and wife on account of uncompromising attitude of the wife who was not willing to restore the conjugal relation with her husband.
Having considered the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Ist, Darbhanga in connection with C.R. No.1786 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
