JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-11-2020 In view of the submission and the undertaking of the learned counsel for the petitioner, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 22.10.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.
Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with POCSO Case No. 14 of 2019, arising out of Mansurchak P.S. Case No. 17 of 2019, registered under Section 376(D) of the Indian Penal Code and Sections 4, 5, 6 and 12 of the POCSO Act and Section 67 of the I.T. Act.
Patna High Court CR. MISC. No.28734 of 2020(2) dt.13-11-2020 2/2 Learned counsel appearing for the petitioner submits that while the bail prayer of the petitioner was refused, on merit, on 19.03.2020 vide Criminal Miscellaneous No. 74897 of 2019 by this Court, but similarly situated coaccused Sujeet Kumar @ Sujeet Thakur @ Gidarba @ Gidorba has already been allowed privilege of bail by a Co-ordinate Bench of this Court on 15.06.2020 vide Criminal Miscellaneous No. 3539 of 2020 and the petitioner has remained in custody since 25.02.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge First-cumSpecial Judge, POCSO Act, Begusarai in connection with POCSO Case No. 14 of 2019, arising out of Mansurchak P.S. Case No. 17 of 2019.
