The petitioner apprehends his arrest in Azamnagar P.S. Case No.246/2015 registered under Sections 313 and 354 of the Indian Penal Code.
The gist of the allegation is that the petitioner administered medicine to the informant causing her miscarriage. Learned counsel for the petitioner submits that the informant earlier filed complaint case bearing 1303 of 2015 on the basis of which the present F.I.R was lodged. The police after investigation, found the accusation false and accordingly submitted final form but thereafter cognizance was taken on protest filed by the informant. There is no material to show that miscarriage was caused due to medicine given by the petitioner.

No.34675 of 2018 (2) dt.03-07-2018 2/2 Considering the aforesaid fact and nature of allegation made against the petitioner and also the fact that the police after investigation, submitted final form, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri D.K.Roy, J.M.1st Class, Katihar, in connection with Azamnagar P.S. Case No.246 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
