Petitioner apprehends arrest in a case registered for the offence punishable under Sections 272/273 of the Indian Penal Code and sections 30a, 41/47 of the Bihar Prohibition and Excise Act.

Police stopped a truck and recovered 1083.600 liters of country made foreign liquor. It is alleged that the said truck was being escorted by a Scorpio from which two persons were apprehended. One of the co-accused arrested on the spot disclosed that the petitioner was the owner of the Scorpio. Learned counsel appearing for the petitioner submits that the petitioner is innocent and nothing incriminating has been recovered either from his vehicle or from the inmates of his vehicle and he is not concerned with the alleged recovery from the truck. As per paragraph 3 of the bail application, petitioner has got no criminal antecedent.

Considering the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner, above named, be released on bail on furnishing bail

No.24632 of 2020(2) dt.08-10-2020 2/2 bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act Purnia in Baisi Police Station Case No. 54 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
