02. In the present case, the petitioner is apprehending his arrest in connection with Pirpainti P.S. Case No. 337 of 2025 registered for the alleged offence under Sections 331(4), 305 of Bharatiya Nyaya Sanhita, 2023.

03. As per prosecution case, while the informant had been away from her home for some religious ritual, unknown thieves after breaking the lock of his house, took away ornaments worth Rs. 15 lakh and cash to the tune of Rs. 11,50,000/- from his house. The name of the petitioner transpired during investigation for being involved in the theft.

04. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this

The petitioner was named in this case on the basis of confessional statements of co-accused persons but they are on inimical terms with the petitioner. Except for suspicion, there is no material against the petitioner. Learned counsel further submits that nothing incriminating has been recovered from person or possession of the petitioner. The petitioner is having clean antecedent.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the clean antecedent of the petitioner and the possibility of false accusation, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur/court concerned in connection with Pirpainti P.S. Case No. 337 of 2025, subject to the condition laid down under Section 482(2) of BNSS and other following conditions:

(i) One of the bailors will be a close relative of

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
