This is an application for grant of anticipatory bail for the offences punishable under Section 7 of the E.C. Act . Allegation against the petitioner is that he was the driver of the Tractor which was seized by the police. It has been submitted on behalf of the petitioner that admittedly from the FIR it appears that he was the driver and as such no case under Section 7 of the E.C. Act is made out. Having heard both sides and in view of the fact that petitioner was driver of the tractor and has not been arrested at the time of seizure, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six
Patna High Court Cr.Misc. No.49920 of 2016 (2) dt.20-12-2016 weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate Purnea in connection with K. Nagar (Maranga) P.S. Case No. 276 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure also with condition that the petitioner shall co-operate with the investigation as well as in the trial.
