JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner, who is aged about 18 years, is in custody in connection with Runnisaidpur P.S. Case No. 49 of 2020 for the offence under Section 30(a)(g) of the Bihar Prohibition and Excise Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. In the instant case, total 865.320 litres of foreign liquor was recovered from the house of co-accused Ram Sakal Rai and Anirudh Rai. Learned counsel submits that the petitioner has absolutely no concern with the seized liquor and nothing has been recovered from conscious possession of the petitioner.
Considering the fact that the petitioner has no criminal
Patna High Court CR. MISC. No.29345 of 2020(2) dt.10-11-2020 2/2 antecedent and he is in custody since 26.05.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Runnisaidpur P.S. Case No. 49 of 2020 subject to the condition that the bailors should be family members of the petitioner.
