The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Excise Amendment Act.

Learned counsel for the petitioner stated that on 15.03.2019 at about 12.30 hours on secret information the informant and police party reached in village Keshopur Bind Toli. After seeing the Police party one person fled away left his motorcycle. Choukidar disclosed the name as Sonu Choudhary. On search of Bora, 50 liters Mahuwa wine was recovered. Learned counsel further stated that nothing was recovered from the conscious possession of the petitioner. There

Patna High Court CR. MISC. No.28559 of 2019(3) dt.22-07-2019 2/2 is no criminal antecedent. The petitioner is innocent and committed no offence. The petitioner has no concerned with said wine or recovered motorcycle.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. (Special Judge), Excise Act, Bhojpur at Ara in Excise Case No. 539/2019 arising out of Barhara P.S. Case No. 94 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
