The petitioner apprehends his arrest in connection with Digha P.S. Case No. 80 of 2018 registered under Sections 30(a), 37(b) and 38(i) of the of the Bihar Prohibition and Excise (Amendment) Act, 2016.
The accusation is of recovery of one bottle containing 375 Indian made foreign liquor from the Maruti Alto Car bearing registration no. BR 312 2556, in which, Nesar Ahmad, Sonu Kumar Singh and Yamuna Singh were found sitting.
Learned counsel for the petitioner submits that, in fact, petitioner is the owner of the aforesaid Maruti Car and the
Patna High Court Cr.Misc. No.33730 of 2018(2) dt.13-06-2018 2/2 same has been released in favour of the petitioner in compliance of order dated 17.05.2018 passed in C.W.J.C. No. 9138 of 2018 by the Division Bench of this Court. It is further submitted that car of the petitioner was taken by three persons for personal use and he has no knowledge about keeping one bottle in the car and petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, (Excise), Patna, in connection with Digha P.S. Case No. 80 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
