The petitioner seeks bail in Kawakol P. S. Case No. 232 of 2018 instituted for the offence under Section(s) 147, 148, 149, 307 of the Indian Penal Code and Section 27 of Arms Act .
In the written report it is alleged that this petitioner along with Ravindra Yadav made firing on the son of informant, namely Upendra Yadav on account of which he sustained firearm injury and fell down.
Learned counsel for petitioner draws the attention of this Court to statement of injured Upendra Yadav which is available in para 45 of the case diary, wherein, he has stated that specific allegation is against co -accused Ravindra Yadav
Patna High Court CR. MISC. No.26912 of 2019(6) dt.11-07-2019 2/2 of making firing upon him on account of which he fell down and became unconscious.
The injury report of the injured is available with the case diary which shows that one entry wound and exit wound was found on the body of the injured caused by firearm. Learned counsel for informant has appeared and opposed the prayer for bail. He submits that petitioner has criminal antecedent and four cases are pending against him. Learned counsel for petitioner submits that petitioner is on bail in all these cases.
The petitioner is in custody since 17.10.2018 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-IV Nawada, in connection with Kawakol ( Rupoa) P. S. Case No. 232 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
