2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 1287.360 litres of illicit foreign liquor has been recovered from the truck in question.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. Petitioner is not named in the FIR, nothing has been recovered from his conscious possession and he has no concern with the alleged recovery.

5. Learned APP for the State has opposed the bail petition and submits that petitioner is the owner of the seized truck in question.

6. Considering the quantity of recovery and the fact that petitioner is registered owner of the seized truck from which the said recovery has been effected, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Shahnawaz/- U T
