JUSTICE ARVIND SRIVASTAVA ORAL ORDER 11-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend arrest in connection with Sadar P.S. Case No. 174 of 2017 registered under Sections 363, 366A and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that the victim in her statement recorded under section 164 Cr. P.C. specifically stated that she has love affairs with co-accused Ghan Shaym Kumar and also voluntarily married with him. Further submission is that the co-accused Ghan Shyam Kumar has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 39722 of 2017.

No.39413 of 2017 (3) dt.11-10-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Saharsa in connection with Sadar P.S. Case No. 174 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
