2. The petitioner seeks bail in connection with Kursela P.S. Case No. 43 of 2025 registered for the offence under Section 111(1), 310(4), 310(5) of the BNS, under Section 25(1-b)a, 26, 35 of the Arms Act and under Section 8(c), 21(b) of the NDPS Act.
3. As per the prosecution case, the petitioner and others are said to have caught by the police river side when they were planning to commit crime and the recovery is of cartridges and smack from the petitioner.
4. The petitioner claims to have clean antecedent and he is in custody since 23.02.2025.
5. Considering the aforesaid facts, this application
Patna High Court CR. MISC. No.28289 of 2025(2) dt.07-05-2025 2/2 is allowed.
6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Sessions Judge, Katihar/concerned Court below in connection with Kursela P.S. Case No. 43 of 2025, subject to the condition that the bailors should be close relative of the petitioner.
7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Barari Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
8. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted. (Sandeep Kumar, J) Vikas/- U
