2. The petitioner, who is in custody since 26.03.2016, has renewed his prayer for bail in connection with Khutauna P.S. Case No. 24 of 2016 for the offences alleged under Sections 413, 414 and 401 of the Indian Penal Code having earlier been rejected by this Court by order dated 12.07.2016 in Criminal Miscellaneous No. 27264 of 2016.

3. It is reiterated that the petitioner has been falsely implicated and in fact, no recovery has been made from the possession of the petitioner. Co-accused Ghuran Mian Minya @ Ghuran Mia @ Ghuran Minya and Ram Bharosh Yadav @ Machhar Yadav have since been granted bail by this Court in Cr. Misc. No. 20907 of 2016 and Cr. Misc. No. 40438 of 2016 respectively.

4. Having regard to the entirety of the facts and circumstances of the case as well as the period of custody since 26.03.2016 already suffered, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction
