JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-07-2018 The petitioners seek bail in anticipation of their arrest in connection with Jandaha P.S. Case No. 74 of 2018, dated 06.04.2018, instituted for the offences punishable under Sections 363, 365, 323 and 504/34 of the Indian Penal Code.
The petitioners are alleged to have abducted the wife and children of the informant when his wife had come
Patna High Court Cr.Misc. No.33719 of 2018 (2) dt.04-07-2018 2/2 out of her house along with her children.
Learned counsel for the petitioners has drawn the attention of this Court to the fact that the F.I.R. was lodged after about five months of the occurrence and no explanation also has been offered for such delay. That apart, the wife of the informant has made a statement under Section 164 Cr.P.C., stating that she had voluntarily gone with petitioner No. 1 and presently she is residing with him. Regard being had to the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-IX, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 74 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
