The petitioner seeks bail in Motihari Excise Case No. 134 of 2019 instituted for the offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016 . Petitioner is in custody since 26.2.2019 having clean antecedent.
In the written report, it is alleged that total 108 litres of illicit Nepali liquor has been seized from a motorcycle on which the petitioner was riding.
Keeping in view the clean antecedent and the period of custody already spent by petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.27290 of 2019(2) dt.26-04-2019 2/2 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Spl. Judge Excise Act, Motihari in connection with Motihari Excise Case No. 134 of 2019 subject to the following conditions:
(i) Both the bailors shall be the close relative of the petitioner.
(ii) The petitioner shall be present on each and every date fixed by the Court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioner.
(iii) If petitioner tamper with the evidence in the case, prosecution will be at liberty to move for cancellation of bail bond of the petitioner.
