Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 393, 307/34, 302 of the Indian Penal Code, Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

The offence alleged is commission of robbery by causing firearm injury. The person apprehended by the police confessed and in his disclosure statement, name of the petitioner surfaced. Petitioner has got no criminal antecedent. Petitioner is in custody since 01.01.2020. Investigation of the case is already

Patna High Court CR. MISC. No.31170 of 2020(2) dt.09-12-2020 2/2 complete against the petitioner.

Submission is that the petitioner was never put on T.I. Parade during investigation of the case nor any incriminating article was recovered from possession of the petitioner. Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Siwan Nagar Police Station Case No. 758 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
