JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 306, 304(B)/34 of Indian Penal Code.

As per FIR, petitioner and other accused persons tortured and harassed sister of the informant as a result of which she committed suicide.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that present case is counter blast of Kanti P. S. Case No. 261 of 2004 lodged by petitioner against the informant of this case. Furthermore, except suspicion there is no material against the petitioner. Petitioner is bhaisur of the deceased. Petitioner is aged about 68 years, suffering from

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, West Muzaffarpur in Kanti P.
