JUSTICE MADHURESH PRASAD ORAL ORDER 02-02-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State of Bihar. The petitioner seeks bail in connection with Sessions Trial No. 215 of 2021;28/21 arising out of Uphara PS Case No. 88 of 2020 dated 31-12-2020, registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged in the First Information Report (for brevity FIR) that husband of informant has been shot dead by the petitioner. Earlier a Co-ordinate Bench of this Court vide order dated 13-01-2023, had called for a report regarding present stage of the trial. In compliance of this Court's order, report dated 19-01-2023 has been received from the Court of learned District and Sessions Judge, Aurangabad, which is kept at Flag- 'R'.
As per report of the learned District and Sessions Judge, Aurangabad, seven (07) witnesses cited in the charge sheet have been examined. Three (03) witnesses, including the informant and Investigating Officer (IO) remained to be examined. The Superintendent of Police, Aurangabad has also been communicated the state of affairs and requested to ensure attendance of the remaining witnesses by the Court.

No.30510 of 2022(4) dt.02-02-2023 2/2 In view of the substantial progress at the trial, having regard to the nature of accusations, the petition is disposed of with a direction to the learned Trial Court to proceed expeditiously without any unnecessary adjournments or undue delay so as to conclude the trial preferable within a period of four (04) months. This Court would expect that the petitioner's counsel would honour his undertaking in the instant proceedings regarding supply of the requisite Court fee etc. within two weeks from the date he is called upon to do so by the office.
