====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 24.08.2018 in a case for the offence registered under Sections 366 and 376 of the IPC.

The prosecution story, in brief, is that the informant Sarswati Devi married her daughter Soni Devi with one Bikram Paswan at Village- Bara, P.S. Tankuppa, District-Gaya in the year 2017. On 18.08.2018 at 10.00 P.M. when Soni Devi was in her Sasural Village-Bara, informant got information that Soni Devi fled away with Sanjeevan Paswan (petitioner) on Bolero

Patna High Court CR. MISC. No.27118 of 2019(2) dt.25-04-2019 2/3 vehicle for the purpose of marriage. After that, informant searched her daughter but she was not found anywhere, then she lodged this F.I.R.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. As per F.I.R., the mother of the victim has stated that the victim was abducted by this petitioner for performing marriage. The statement of the victim under Section 164 of Cr.P.C. has been recorded vide Annexure-3 to the present application. She admits that there was love affairs between the petitioner and the victim as the husband of the victim was residing at Mumbai.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-VIth, Gaya, in connection with Sessions Trial No.
