The petitioner has preferred this application for grant of regular bail in a case registered under sections 392 and 412 of the Indian Penal Code.

As per the prosecution case, the petitioner and one another person who were on motorcycle were caught with Rs. 2 lacs in cash contained in a bag which they had snatched from one Vasudeo Rai.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for reasons other than what has narrated in the FIR. An altercation took place between the parties over the registration number of vehicle of the petitioner which was of Madhya Pradesh. No such occurrence as alleged has taken place. Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having any criminal antecedent and having remained in custody for 1 year, the petitioner is directed to be enlarged on bail in connection with Kotwa P.S. Case no. 36 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
