The petitioner apprehends his arrest in connection with Hajipur Sadar P.S. Case No. 618 of 2021 instituted under Sections 341, 323, 504, 506, 498(A), 494/34 of the Indian Penal Code and Section 3 and 4 of the D.P. Act. On 1.11.2022, a coordinate bench of this Court had referred the matter to the Mediation Centre so that the parties could come to an amicable settlement.
A report dated 9.12.2022 of the Mediator has been received, according to which the parties failed to arrive at mutual solution despite the fact that the proceeding was held
Patna High Court CR. MISC. No.28689 of 2022(6) dt.10-01-2023 2/3 on 1.11.2022 and thereafter on 7.12.2022.
Learned counsel for the petitioner submits that he being the husband of the lady (opposite party No. 2) is duty bound to take care of her as also his 10 years old child and accordingly irrespective of the result of this case, he is ready to pay Rs. 10,000/- per month beginning January 2023 which will be paid in the account of the opposite party No. 2 ( Ac. No. 110044690444- Canara Bank, IFSC- CNRB0017594, MICR- 844015007).
Taking into account the fact that the mediation has failed and ultimately the petitioner has to face the music, this Court is inclined to grant him relief subject to payment of Rs. 10,000/-, as stated above. Failure to do so by 10th of every month, the informant shall be free to take steps for cancellation of his bail.
Let the petitioner be released on bail, in the event of his arrest or surrender before the subordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each in connection with Hajipur Sadar P.S. Case No. 618 of 2021 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, subject
