====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 12-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Muffasil P.S. Case No.106 of 2017 registered under Sections 341, 323, 379, 324, 307, 354 and 504/34 of the Indian Penal Code. The accusation is that when Rani Kumari, the daughter of the informant Geeta Devi, was going to attend the call of nature in the filed situated in front of the house of Sunil Nut, at that time, Sunit Nut started to abuse her. When the informant rushed to rescue her daughter, she was pushed on the ground catching her by the petitioner no.2 Sangeeta Devi. Thereafter, Anil Nut alias Modi and Sunil Nut caused assault to the informant through fists and

Patna High Court Cr.Misc. No.48052 of 2017 (2) dt.12-10-2017 2/2 slaps and Sunil Nut snatched the gold ear ring of the informant. In the meantime, when the husband of the informant came there, he was assaulted by Tuna Nut through Khanti on his head. The informant was also assaulted by Tuna Nut on her head through Khanti. Anil Nut caused injury to the daughter of the informant on her head. The petitioner no.2 Ghurma Nut also abused and caused assault to the informant.

Learned counsel appearing on behalf of the petitioner submits that while the petitioners are named in the F.I.R. but the allegation against the petitioner no.1 is catching hold of hair of the informant whereas there is general allegation against the petitioner no.2 to abuse and cause assault to the informant.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Muffasil P.S. Case No.106 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
