This application for the grant of anticipatory bail arises out of Mohinuddin Nagar P.S. Case No. 18 of 2018, disclosing the offences under Sections 302, 201 and 120(B) of Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner is mother of the accused Manoj Kumar Poddar and has falsely been implicated in the present case. The specific allegation is against the son of the petitioner but the petitioner is neither involved in the said occurrence nor he helped the accused in disposing of the dead body. Considering the facts and circumstances of the case let the petitioner, above named, in the event of arrest or surrender before the Court below within six weeks, be released on furnishing bail bond of Rs. 10000/- (ten thousand), with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur, in connection with the Mohinuddin Nagar P.S.
